Before a construction site can discharge groundwater into the storm drain a NPDES (National Pollutant Discharge Elimination System) Permit must be obtained from the California Regional Water Quality Control Board. Depending on the geographical location of the job site, this process can take 6-12 weeks and can cost as much as $18,000 to complete the application process.

How long is the permit valid for?

The NPDES permit is valid from July 1st to June 30th every year and an open permit needs to be renewed by June 30th if the owner requires continued discharge of their groundwater. This process is easily done by notifying the Regional Board in writing prior to the June 30th deadline and paying the permit fee ($11,734 in most regions).

What happens if I do not obtain a permit?

If a contractor chooses to forgo a NPDES Permit and discharge illegally, then they risk the job site being shut down and fines up to $25,000 per day plus $25.00 per gallon. Also, it is not just a financial impact when an illegal discharge occurs, the environment pays a price as well.
